Update your links and bookmarks
« on: October 18, 2008, 04:03:24 pm »
Since scammers have gotten a hold of the old domain, please make sure to update all of your links and encourage all site owners to update their links to use forums.soldat.pl

The old domain will not be coming back.  Some sleazy company has gotten hold of it and doesn't appear to be willing to sell it.

Please do not visit the old domain, as they bring in ad revenue for any time it is viewed or links are clicked on it.  I'll save you the work, the old domain contains nothing now but a page full of links to products they want you to buy.

It is imperative that everyone update their bookmarks and encourage all site-owners to update their sites.  The new forums don't even show up on google at all yet because nobody links to them.  It will take a lot of sites changing before the new forums show up on google like the old ones do.

The sooner we get this all sorted out, the sooner you will all be given another surprise (a good one this time)

FLAB, I had a friend who suggested you put in an application to WIPO about the domain. Apparently, if WIPO decides that the domain belongs to You/MM, you'll get the domain back or something.

The old domain will not be coming back.  Some sleazy company has gotten hold of it and doesn't appear to be willing to sell it.

Did you contact your registrar for advice? I thought there was supposed to be a period after expiration where only the original owner could register.

ICANN has a policy called Uniform Domain Name Dispute Resolution Policy (UDRP) but this does not seem to apply in this case because it seems to have some sort of trademark requirement. I can't say I fully understand the policy and how it should be used though.

Link to WHOIS information.

Good luck.

From an actual decision:

Quote
Common Law Trademark Rights

Panels interpreting the UDRP have consistently held that the Policy affords protection to those having common law trademark rights as well as to those having rights in registered trademarks.  See, Cedar Trade Assocs., Inc., v. Ricks, FA 93633 (Nat. Arb. Forum Feb. 25, 2000); see also Bennett Coleman & Co. Ltd. v. Lafwani, D2000-0014 (WIPO Mar. 11, 2000) (“it is this reputation from actual use which is the nub of the complaint, not the fact of registration as trade marks.”). Many of the cases in which common law trademark rights are asserted have involved personal names that have, through use and publicity, acquired the distinctiveness necessary to become trademarks or service marks: van Hooijdonk v. Tait, D2000-1068 (WIPO Nov. 4, 2000); Stam v. Cohen, D2000-1061 (WIPO Nov. 4, 2000); MPL Communications Ltd. v. Hammerton, FA 95633 (Nat. Arb. Forum Oct. 25, 2000); Feinstein v. PAWS Video Prods., D2000-0880 (WIPO Oct. 21, 2000); Carter v. Afternoon Fiasco, D2000-0658 (WIPO Oct. 17, 2000); Ciccone v. Parisi, D2000-0847 (WIPO Oct. 12, 2000); Estate of Getz  v. Vogel, D2000-0773 (WIPO Oct. 10, 2000); Adjani v. Second Orbit Communications, Inc., D2000-0867 (WIPO Oct. 4, 2000); Estate of Shakur v. Shakur Info Page, AF 0346 (eResolution Sep. 28, 2000), Estate of Francis v. Magidson Fine Art, Inc., D2000-0673 (WIPO Sep. 27, 2000); Adu v. Quantum Computer Servs. Inc., D2000-0794 (WIPO Sep. 26, 2000); Marino, Jr. v. Video Images Prods., D2000-0598 (WIPO Aug. 2, 2000); Rattner v. BuyThisDomainName, D2000-0402 (WIPO July 3, 2000); Monty and Pat Roberts, Inc. v. Keith, D2000-0299 (WIPO June 9, 2000); Roberts v. Boyd, D2000-0210 (WIPO May 29, 2000); Winterson v. Hogarth, D2000-0235 (WIPO May 22, 2000); see also Sean Michaels Inc. v. Mark Allan Online Enm’t, AF 0214 (eResolution July 2, 2000).

ie: You don't have to have a trademark registered if you have come to be known by that name.

It's my belief that should relief via arbitration be persued, MM would prevail and have the original domain returned; this can be done electronically.

edit: scratch that; fees for resolving under the UDRP amount to $1300US. Not gonna happen.

MM is going to contact his registrar soon to figure out what the hell happend and ask how he lost the domain.  I was also under the impression that there is a grace period after the domain expires before it can be re-registered.  I'll look into how WIPO might help get the domain back.

Most registrars do, but AFAIK there is no requirement on their part to do so.

edit: are you sure that the current page displayed isn't done by the registrar, while the domain is in it's grace period? Some registrars do this when a domain is expired but in the grace period; redirect it to advertising until either the domain is paid for, or they delete it completely. MM is still listed as the registrant on the whois, and the blurb at the top leads me to believe that it's done temporarily.

MM really should check into it.

Umm... this link:

Link to WHOIS information.

Tries to check the WHOIS information for forums.soldat.pl, which is not a proper domain name and hence doesn't give any information. Here's the link to the WHOIS information for the old domain name:

Proper WHOIS information link

Just realized that BruceCage probably typed the URL of the old domain name itself, but due to this forums' new filter, it was automatically changed to forums.soldat.pl.

Notice how it's still in MM's name?

If the domain really was taken, MM wouldn't be the registrant still; I really think the domain is just in it's grace period and been temporarily redirected to advertising until it's payed for.

chris, that isn't MM (I think the old domain was registered under his brother's name), and it definitely is owned by someone else now, they just seem to have the old contact info listed in the whois.  I wouldn't be surprised if this sleazy company just uses the previous owner's whois information to confuse matters.

onlinenic.com is not the registrar that MM uses.  If the domain hadn't expired or otherwise been under the control of someone else, it would still be pointing at my nameservers, instead it is pointing at ns*.onlinenic.com.

the registrar MM uses is a .pl site that is in no way connected to onlinenic.com, this is just another company that preys on expired domains.

As was previously mentioned, the Wayback Machine has removed all archives due to the new domain owner's robots.txt file.

I've sent them an email explaining the situation:

Quote
To Whom It May Concern,

Soldat Forums was recently the victim of a hostile domain takeover as of October 6th of soldatforums.com by a company that now uses the domain's traffic for ad revenue.

It was a hurtful blow to the community, right after the domain was taken away, that the Internet Archive restricts archive access due to the new robots.txt file. We understand why the Internet Archive respects robots.txt retroactively, but if you could make an exception for our community's benefit then we would be most appreciative.

If you want to check out our new forum, it's been moved to http://forums.soldat.pl/

Thanks!,
Soldat Forums Staff

Hopefully they keep backups!

I don't understand why they stole it in the first place, they will gain nothing but very short-term accidental traffic, then nothing.

I don't understand why they stole it in the first place, they will gain nothing but very short-term accidental traffic, then nothing.

but that is worth it if they make anything more than the $10 or so that it took to buy  the domain for a year.  Plus, if they can sell the domain back to the people that originally had it after 6 months, they make even more.
